DISCUSSION

            A.  Standard of review

            Summary judgment is properly granted where there are no triable issues of fact and the moving party is entitled to judgment as a matter of law.  (Code Civ. Proc., § 437c, subd. (c).)  We review the court’s decision granting a summary judgment de novo.  In doing so, we liberally construe all conflicting facts in the light most favorable to the party opposing the motion.  (Wiener v. Southcoast Childcare Centers, Inc. (2004) 32 Cal.4th 1138, 1142; Pacific Shore Funding v. Lozo (2006) 138 Cal.App.4th 1342, 1348-1349; Crouse v. Brobeck, Phleger & Harrison (1998) 67 Cal.App.4th 1509, 1520.)
